Terms of service

LarkDay is operated by Nexavas Inc. (Québec, Canada) — "we", "us". These terms form an agreement between Nexavas Inc. and the childcare centre that uses the service ("you").

LarkDay is software-as-a-service for childcare centres. It is NOT a payment processor — we do not collect tuition from families on a daycare's behalf (our payment scope is the daycare's own subscription).

The person who creates an organization (org admin) represents that they are authorized to bind the daycare to these terms. You are responsible for your account credentials.

Use the service only for legitimate childcare operations. No unlawful, malicious, or infringing data; no impersonation; no attempts to access another tenant's data.

Pricing: a CAD $39/month floor plus $3 per active enrolled child/month; monthly or annual. Billing changes and reductions take effect at the period boundary (no mid-cycle proration; annual upgrades are prorated immediately). A 14-day trial requires no card and soft-locks at expiry. Card/bank data is handled solely by Stripe.

You may cancel at any time, effective at the period end. You may export your data; after departure, data is retained per the retention schedule in our Privacy Policy and then deleted.

The service is provided "as is" without warranties to the extent permitted by law. Our liability is limited as set out in this agreement. You agree to indemnify us against claims arising from your misuse of the service or your content.

Either party may terminate per this agreement; we may suspend for non-payment or violation of these terms, with notice where practicable.

These terms are governed by the laws of Québec, Canada; the courts of Montréal or Québec City have jurisdiction. Nothing here waives your rights under Québec consumer-protection law.
